Article 1. Definitions
In these terms and conditions, the following definitions apply:

Consumer: the natural person who is not acting for purposes relating to their trade, business, craft or profession.
Distance contract: a contract concluded between Nordal and the consumer via the webshop.
Products: all care products and related items offered via the webshop.
Webshop: Nordal’s online shop at nordal-care.com.
Article 2. Applicability
2.1 These terms and conditions apply to every offer made by Nordal and to every contract concluded via the webshop.
2.2 Before the contract is concluded, the text of these terms and conditions is made available to the consumer in such a way that it can easily be saved.
2.3 If additional product or promotional terms apply alongside these terms and conditions, in the event of a conflict the provision most favourable to the consumer applies, unless mandatory law provides otherwise.
Article 3. The offer
3.1 The offer contains a complete and accurate description of the products offered.
3.2 Obvious mistakes or errors in the offer are not binding on Nordal.
3.3 Images, colours, specifications and other product information on the website are intended as the most accurate representation possible. Minor deviations do not give rise to a right to compensation or termination, unless as a result the product does not conform to the contract.
3.4 The offer clearly states the price including VAT and, where applicable, any shipping costs.
Article 4. Conclusion of the contract
4.1 The contract is concluded at the moment the consumer accepts the offer and meets the conditions set.
4.2 After receiving the order, Nordal sends a confirmation by email.
4.3 Nordal reserves the right to refuse an order or to impose additional conditions if there is reason to do so.
Article 5. Prices and payment
5.1 All prices stated are in euros and include VAT, unless stated otherwise.
5.2 Any shipping costs are clearly stated before the order is completed.
5.3 Payment must be made using the payment methods offered on the website.
5.4 Nordal is entitled to correct obvious pricing errors.
Article 6. Delivery
6.1 Nordal will process and ship orders with due care.
6.2 Delivery takes place at the address provided by the consumer.
6.3 If an order cannot be fulfilled, or can only be partly fulfilled, the consumer will be notified as soon as possible.
6.4 The risk of damage to or loss of products rests with Nordal until the moment of delivery to the consumer or to a third party designated in advance.
Article 7. Right of withdrawal
7.1 The consumer has the right to withdraw from the contract within 30 days of receiving the product without giving any reason.
7.2 During the cooling-off period, the product and its packaging must be handled with care. The product may only be used or examined to the extent necessary to establish its nature, characteristics and functioning.
7.3 If the consumer exercises the right of withdrawal, they must notify Nordal of this within 30 days of receiving the product.
7.4 After notification of withdrawal, the product must be returned within 7 days at the latest.
7.5 Refunds are made within 14 days of the withdrawal being notified, provided the product has been received or sufficient proof of return shipment has been provided.
Article 8. Return costs
8.1 The direct costs of returning the product are borne by the consumer in the case of a regular return within the cooling-off period.
8.2 If a product was delivered damaged, the wrong product was delivered or it does not conform to the contract, the return costs are borne by Nordal.

Article 9. Exclusion of the right of withdrawal
9.1 The right of withdrawal may be excluded for products that are not suitable for return for reasons of health protection or hygiene and whose seal has been broken after delivery.
9.2 If an exception to the right of withdrawal applies, this is clearly stated with the product concerned.
Article 10. Conformity and complaints
10.1 Nordal guarantees that the products conform to the contract, the stated specifications and the reasonable requirements of soundness and usability.
10.2 If a product does not meet the reasonable expectations the consumer may have of it, the consumer is entitled to an appropriate solution.
10.3 Complaints about products or the performance of the contract must be submitted, fully and clearly described, within a reasonable time after discovery via info@nordal-care.com.
10.4 Nordal aims to respond to complaints substantively within 14 days of receipt.
Article 11. Use of products
11.1 Nordal products are intended solely for use in accordance with the directions on the packaging and on the website.
11.2 The consumer is responsible for carefully reading and following warnings, directions for use and safety information.
11.3 Nordal is not liable for damage resulting from incorrect use of a product or use contrary to the instructions given.
Article 12. Liability
12.1 Nordal’s liability is limited to what is required under mandatory law.
12.2 Nordal is not liable for indirect damage, including consequential damage, loss of profit or non-material damage, unless there is intent or deliberate recklessness, or unless mandatory law provides otherwise.
Article 13. Intellectual property
13.1 All intellectual property rights relating to the website, texts, images, logos, product names and other content are held by Nordal or its licensors.
13.2 Without prior written permission, it is not permitted to copy, publish or otherwise use material from the website, except insofar as permitted by law.
Article 14. Privacy
14.1 Nordal processes personal data in accordance with applicable privacy legislation.
14.2 More information on the processing of personal data can be found in the privacy statement on the website.
Article 15. Force majeure
15.1 Nordal is not obliged to fulfil any obligation if this is not reasonably possible due to force majeure.
15.2 Force majeure also includes disruptions in transport, logistics, internet, telecommunications, payment traffic, government measures and other circumstances beyond Nordal’s control.
Article 16. Applicable law and disputes
16.1 All contracts between Nordal and the consumer are governed by Dutch law.
16.2 Disputes will be submitted to the competent court in the Netherlands, unless mandatory law provides otherwise.
